Arizona Immigration Laws...?

The bill is fascism, pure and simple. I want to take all of its supporters and make their tyranny-loving asses live in North Korea for about 5 years. Maybe then they won’t be so cavalier about giving up their freedom to fight the brown menace.

Don’t want immigrants living off of your tax dollars and clogging your emergency rooms? Here’s a freaking amazing idea: get rid of the welfare assistance for illegals. It solves the problem without turning us into Soviet freaking Russia.

@Cork, I’m all for ending the welfare state but it ain’t gonna happen. There’s really not even broad Republican support for scaling down medicare or social security let alone taking them apart. I’m not sure what the Republican numbers are on Medicaid and Welfare but I do know that the left would be unanimously opposed to their elimination. Plus they’d call out Republicans on their unequal treatment of Medicare and SS and they’d be right to do so. Needless to say, It just cannot be done.

Oh, don’t get me wrong, I’m not suggesting it would be politically feasible to immediately end the welfare state for everyone. But I think it would be fairly easy to end it for illegals. If the public hates illegals badly enough to pass such a draconian law, how hard would it be to pass some sort of measure ending their welfare benefits (eg, requiring people to show their documents before using public services)? Hell, even stashing a few border patrol agents in every emergency room would be superior to this ridiculous law.

Jerry Driscoll provides some interesting background.

I don’t carry my wallet with me everywhere I go when I hitch rides with family/friends. Usually I do that so I am not tempted to purchase items. If this law is saying police can apprehend me if I don’t have these approved IDs on me at all times, then what if I choose not to supply them with the requested information? Will they deport me? How do they know where I am from? Will they lock me in jail for life if I don’t show them ID? Or will they let me go after they fine me?

My guess is that they’d hold you until they could ascertain your legal status.

Regardless of the legal aspects. The discrimination of immigrants is both disgusting and reprehensible. I don’t consider someone who supports what Arizona is doing or what some radical conservatives are supporting - like deporting all illegal immigrants - as either intelligent or libertarian. Not only do immigrants (legal and illegal) have every right to live in whatever country they wish, they are good for first world nations and generate growth to the economy that could not exist without them.

Am I free to go?

No. (as a matter of law when you are not free to go what are you?)

I assert my right to remain silent and exercise constitutional guarantees under the 5th and 6th amendments.

Key SCOTUS rulings: Terry, Hibel

Under the constitutional citation of above you can not be compelled to witness against yourself.

Under the 14th Amendment privileges and immunities of each state is supposed to be honored by all other states. If you read AZ law (or the DMV acceptable ID literature) you will notice AZ does not honor ID’s from all other states.

There have been good questions raised on premption and whether due process still applies to the legislature (Dred Scott).

People in the border zone already have no civil rights so it changes not that much.
