Someone I know will possibly be selected for jury duty. In light of this, I’m asking about the procedure behind jury nullification. For those of you who’ve done it, do you bring up this belief of nullifying laws while under voir dire? I’ve heard on the Lew Rockwell Blog that some people get out of jury duty for doing that. As I understand, it does not have to be declared (just say not guilty). Anyone have some insight? Do they specifically question about this belief on voir dire?
there is no procedure as far as I understand it, aside from the normal things juries do. The only difference is that when you go to deliberate you find a not guilty verdict even if the facts of the case, etc. show that the defendant is guilty. Of course, this can be abused and should only be used in exceptional cases. However, with the bureauvratic nightmare in the courts now and ridiculous rules it might be the case that many cases are “exceptional”.
The jury usually has one or two “backup jurors.” I assume if you are causing too much of a hassle about nullification they would just replace you with one of those.
