But for some reason when the IRS loses it never becomes a precident. They’ll happily charge someone else with exactly the same offense as soon as the opportunity comes up. He’ll lose and then the IRS will say there that settles the question. Their lawyers, stinging from this defeat, are probably searching for another case right now.
