if someone punches someone elses tetas but causes no harm what kind of “punishment” can they receive in an ancap society. in other words, what is the arbirtation between parties that have not made contract with each other and one causes non-material harm; invasion of privacy, unlawful arrest, etc.
Define “harm.”
If you mean “harm” as in “physical harm” then you ignore psychic values and if there was harm done on a psychic level, then there is retribution to be had.
On the other hand, if “harm” refers to all possible harm, then it wouldn’t make sense to prosecute the aggressor because the person who was “aggressed against” clearly doesn’t care.

If your opinion that no harm (in the latter sense I wrote of) happened, then the response would be to do nothing because they would be expending resources for no reason whatsoever.
However, I’m guessing you WOULD take some issue with either of these circumstances, and therefore you fall into the first sense I wrote of, no physical harm is done, yet psychic harm is. So, restitution is still owed and your arbitration agency would decide what that would be (likely based on community standards and practices, considering the impossibility of measuring psychic harm).

Justice has been done when the damage to the victim has been undone. If someone hits you but does not harm, then all that justice can be is a stern warning.
