How these governmental laws eventually link up. What does Bush’s “No Child Left Behind” have to do with mandatory swine flu vaccines? On the face of it I didn’t realize this, but now after a court ruling the former comes into direct support of the latter. A news article that covered a West Virginia court ruling points this out as the court in it’s ruling appealed to one of the effects of “No Child Left Behind”:
" Unfortunately for the mother, the school district has been under state control since 2005, which means for immunity purposes it is considered an arm of the state, and under the 11th Amendment, the state may not be sued without its consent. (The judge said a regular county school system in West Virginia–one not under state control–would not have such immunity.)"
The reason this school district is under state control is because according to “No Child Left Behind” once a school district fails to meet the educational standards outlined in this government policy that school district falls under the control of the residing state, in this case West Virginia. And what is explicitly mentioned here is the state can not sue the state without the state’s consent and of course the state is not going to sue itself. So the mother who tried to sue to not have her 6 year old daughter given a mandatory swine flu vaccation lost the court case.
