I need an authority or two to cite for an article. The main work of the article is done, this is a peripheral matter but I have to include it. What I hope to find from a libertarian perspective is a work on incorporation, and particularly on the Federal government’s efforts beginning in the sixties to cut down on coercive interrogation by throwing out evidence obtained that way in criminal proceedings. I know many of you have an an/cap perspective from which it would seem that the entire exercise is futile because the state only ever coerces. I get that that. However, that does not help me. I need something - a book or article - which focuses on incorporation as it applies to police custody/interrogation.
I hope to contrast this with today, when the NDAA, Padilla case, and so forth would seem to indicate that the federal goverment is decidedly moving away from limits on coercive interrogation and in fact may be encouraging it. I guess I will use Sheldon Richmond for this.
