Separation of Marriage and State

Hi guys,

I’m writing a Senate resolution for class on the separation of marriage and state. There are surprisingly few valuable papers on this subject after a quick Google search. I’m not looking for a discussion on whether to separate the two - there’s pretty much a consensus here - but rather how you would enact the bill (what powers would it have?) and what the general consequences might be.

Here is my tentative powers section in a nutshell:

  1. Alter Title 1,7. of the U.S. Code (can someone explain the application of this definition? Does this legally define marriage as between man and woman?)

  2. Deletes the ‘married’ tax bracket. or assigns the entire tax restructuring to the head of the IRS (to be approved by the Congress). (currently, my bill does the latter)

  3. Allows all existing property agreements between married individuals to persist as contracts (which is all they are, right?)

I am not a lawyer. If you explain you are a student and tell them you just want it worded properly etc., etc. a lawyer might be able to help you and probably would not even charge you (not all lawyers are blood sucking vampires). There is a group of libertarian-leaning lawyers who would probably be quite sympathetic to your cause and might help you out. They are called the Institute for Justice.
