I have a business idea. I can’t really say what it is, but it will involve the hiring of hotties, who will be required to be scantily clad during the course of their work. It’s not porno, and doesn’t have anything at all to do with the sex industry.
I don’t know what the laws are. I don’t want to get sued by some less attractive woman who is more qualified, who is passed over for a less qualified hot chick.
Is this going to be a problem for me in 21st Century America?
Couldn’t a case be made that a more attractive woman IS more qualified for the job? It sounds like the two would be nearly synonymous here if you the job really does require good looks.
Aside from that, I’m not sure if there are any laws regarding things like this.
b) absolutely. At the risk of revealing too much, I got the idea because where I used to work, there was a roach coach (an affectionate term for a mobile deli) that was owned and operated by a big, burly dude. One day, another roach coach pulled up and out hopped 2 absolute goddesses wearing very tiny bikinis. Needless to say – even though their food was more expensive – the burly dude was out of business by the end of the summer, at least in our part of town.
Even if the laws allow it right now, they can always change overnight. Your business plan would have to have higher profit margins to compensate for the higher legal risk.
Usually counts as “discrimination”. Even if the job requires hotness as a main quality (e.g., personnel for brothels), you might get sued since everyone is able to serve as an object of pleasure and the looks of a person are often deemed to be off-limits for an employer.
