I am aware of and accept the title transfer theory of contracts but have always had some questions about contracts:-
- Is it a breach of contract to try to leave a contract before it’s over?
- What if one side keeps changing the terms away from what was originally signed? is it justified to leave then and would that be a breach?
- If so ,can you ever leave a contract before it’s due to finish if you change your mind or are been treated unfairly or some such like situation?
- If one side breaches the contract is it null and void?
- Do you think the small print is binding to? my immediate thought is to say no if not seen or not mentioned or hidden etc since contracts require consenting to the terms too.
- What if the contract is vague and one party abuses this? would this be binding? should we follow the exact wording of the contract or that plus it’s spirit?
- What if the contract requires you to commit aggression for some reason or is vague enough that it is required?
