The current Strauss-Khan imprisonment lead me thinking. In an an-cap society, if he was falsely imprisoned, what criteria should be used by the PDA to compensate him? Should he be compensated for losing work? A man like Khan probably makes millions, so for a week of wrongful imprisonment, he should theoretically be compensated with maybe millions of dollars. But is that right? Libertarians believe only in crimes related to property, so in case of imprisonment the only property that was harmed was the body of Strauss-Khan. But how much is that body worth? Does it worth more than the body of a poor individual? Would it be un-libertarian to compensate Khan for missing his very expensive work days?
Your whole post is riddled with wild fallacies that would make even a socialist think. First you ask if there was no state how would we fix a problem that exists in the state. After that you make the statement that libertarians only believe in crimes related to property, which makes no sense and is false.
A. The man is head of the IMF, an organization that exists using money stolen from tax payers. So he should get no compensation ever and any money earned at the IMF should go back to the tax payers.
B. Libertarians belive crimes have victims who had their person and/or property aggressed against. In the case of a rape, person or property has been agressed so there is a real crime.
C. Technically, at this point there is only an acusuation of rape, because he is French, the court fearing flight risk has detained him. And because of the seriousness of the crime the court probably has kept him in prison awaiting a more formal hearing on May 20. So probably on May 20 he will get bail and have to stay in the jurisdiction until trial. So even if the whole thing is crap, under US Law he can be detained.
The detention is clearly not necessary here. The person can be monitored and although accused of a violent crime, probably will not commit another one awaiting trial. Of course the real tragedy here is that it takes months to years to have these trials when the US Constitution guarantees people the right to a speedy trial.
My question was abstract, not specific to Khan’s case. I was asking whether compensation for kidnapping/false imprisonment should include missed days on work. On one hand it sounds right, on the other hand, why would the body of a rich person worth more than the body of a poor person? The follow-up question would then be, if indeed the rich should be compensated more, then it means PDAs will never arrest people such as Bill Gates, unless they were 100% sure he would be convicted, even if letting Bill Gates walk free would make him flee, or harm other people.
It would of course include damages.
Different bodies have different values to different people for different reasons at different times, always.
Depends of the value of their daily income and if that income stopped when kidnapped.
I don’t think rich guys would care much about monetary retribution. They’d rather wish to destroy the people who made this happen (the hotel, in this case). I suspect rich people in a free society would work entirely on an other level, above PDAs.
