Will this act allow the state to lock up a US citizen indefinitely without a trial?

Not only CAN the government do this but DOES do this. Lets look at the experience of Jose Padilla, AN AMERICAN CITIZEN RESIDING IN THE USA AND ARRESTED IN THE USA:

  1. May 2002-Arrested as material witness

  2. June 2002-Declared by the Bush (Freedom Love it of Leave it) (Land of the Free, Home of the Brave) Team to be an enemy combatant.

  3. January 2006-Declared not an enemy combatant but a conspirator.

  4. August 2007-Found guilty by a jury.

  5. January 22, 2008-Sentenced to 17 years in prison.

Total for a citizen who has a right to a speedy trial: 5 years, 5 months.

I wonder if they will give him time served since the original arrest.
