EPA To Force Texas Power Plants to Shut Down Next Summer

Texas is fighting tooth and nail to stop this rule form going into effect. Barry Smitherman is fighting too and he is part of every lawsuit that Texas has against the EPA.

Specifically, if the EPA has its way, Texas will be forced to shut down many power plants which will cause a shortage of energy. This could be deadly in the Texas Summer heat for the sick and elderly.

Texas Governor Rick Perry, a 2012 Republican presidential candidate, is fighting back against this potential power shutdown and has said that the EPA rule “threatens Texas jobs & families.”

My question is this, what if Texas simply ignored this ruling and allowed the power plants to remain open? Would they send fed agents into the plant to shut it down anyway? And if so, could Texas send their own agents to make the fed agents stand down?

We could see the Texan governor send in his agents to stop the EPA, but I wouldn’t be surprised if the President ordered federal troops in to stop them. The Little Rock incident has set precedent after all.

You could see Rick Perry sending his agents to stop the EPA? He hardly lifted a finger during the legislative session for our anti-TSA groping bill, which was nullification at its finest. The Department of Justice threatened to make Texas a no-fly zone so he cowered even more. He ignored other 10th Amendment bills too. During the final week of the special session he made some squawking noises in support of stopping the TSA, but that was far too late to get the bill through. Perry isn’t even that great of an opportunist, but thankfully many of his donors’ interests involve the corporatist boondoggle that is energy in the Texas (and everywhere) so maybe he will intervene for that reason at least.
