Pasteurizing wine would destroy it, and no, not all juice has ot be pasteurized. The regulations are, as you’d expect, complicated. When I looked into opening my own winery I got more different answers than agencies I contacted. When I spoke with an aquaintance who already has his own winery he told me he just hired a lawyer who basically bullied his way through the paperwork.
I’m not sure if that’s the justification for the law, but simply because wine is fermented is by no means a preservative. Higher proof (distilled) alcohols may be, but wine is generally in the 13-18% alcohol range and it’s more than possible for quite a few organisms to live in that mix and destroy the wine. Ask anyone who has made some and not sanitized correctly.
